Regulations for Promotional Campaigns conducted in the Eveline.pl e-Shop

These Regulations define the terms and conditions of participation in Promotional Campaigns organized in the Eveline.pl online store, the subject of which is the transfer of an additional Product indicated in the promotional materials of a particular Promotional Campaign, as part of the purchases made by the Participant in the Products covered by the Promotional Campaign, placed in the Online Store in the tab https://eveline.pl/pages/okazje

2. Organizer

The organiser of the promotional campaigns is the company operating the Eveline Cosmetics e-Shop, Beauty Brands Ecommerce sp. z o. o., with its registered office at ul. Żytnia 19, 05-506 Lesznowola, entered into the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under the KRS number 0000760609, share capital: PLN 5,000, REGON: 381956358, NIP: 1231417982;

3. General provisions

3.1 Promotional campaigns will be conducted in the Eveline Cosmetics online store operated at https://eveline.pl (hereinafter referred to as the "Online Store").

3.2 Promotional Campaigns will be conducted on the dates indicated in the promotional materials of a particular Promotional Campaign published in the Online Store in the https://eveline.pl/pages/okazje tab (hereinafter referred to as the "Promotional Sales Period").

3.3 Participation in Promotional Campaigns is completely voluntary.

3.4 Any natural or legal person who, during the Promotional Sales Period, depending on the type of Promotional Campaign, purchases Eveline Cosmetics brand products covered by a given Promotional Campaign for the amount indicated in the promotional materials of the individual Promotional Campaign posted in the Online Store under the https://eveline.pl/pages/okazje tab, may be a Participant in a particular Promotional Campaign. By fulfilling the terms and conditions of purchase of Promotional Products specified in this point, the Participant in a particular Promotional Campaign will automatically receive an additional product (for PLN 1) indicated in the promotional materials of the individual Promotional Campaign posted in the Online Store under the https://eveline.pl/pages/okazje tab (hereinafter referred to as "Your gift").

3.5 In the event of exclusion of products or series from individual promotional campaigns, such information will be included in the promotional materials of the individual Promotional Campaign posted in the Online Store in the tab https://eveline.pl/pages/okazje

3.6 The “Your Gift” product cannot be exchanged for cash or other equivalents.

3.7 The number of Gift Products covered by a particular Promotional Campaign is limited. In the event that the Free Products are exhausted, the Free Product is not in stock and it is not possible to transfer it, the Participant shall not be entitled to any claims against the Organizer in this respect.

3.8 A Participant of a particular Promotional Campaign is entitled to only one Gift per Promotional Campaign. Promotional Campaigns cannot be combined with each other. Each Promotional Campaign does not apply to wholesale purchases. The Parties understand wholesale purchase as the purchase during the period of validity of a given Promotional Campaign during one transaction of more than 10 pieces of the same product or more than 15 pieces from a given product series.

3.9 If the Organizer obtains information about circumstances indicating that the Participant of a given Promotional Campaign made a purchase as part of wholesale purchases, the Organizer is entitled to refuse to accept the order on the terms of the given Promotional Campaign or to demand the return of the benefit resulting from the Free Product awarded as part of the given Promotional Campaign and wrongfully obtained by the Participant.

3.10 The Promotional Campaign will be announced in the Online Store

3.11 All information about each Promotional Campaign contained in promotional and advertising materials is of an additional nature only. The provisions of these Regulations have binding legal force and priority over other materials.

3.12 By taking part in a specific Promotional Campaign, the Participant agrees to the general terms and conditions of Promotional Campaigns specified in these Regulations, including consent to the processing of his or her personal data.

4. Withdrawal from the contract

4.1 The Participant has the right to withdraw from the contract in accordance with the provisions of law and the general principles applicable in the Online Store, subject to point IV paragraph 2 of the Promotional Campaign Regulations.

4.2 In the event of withdrawal from the Gift sales agreement, the Organiser will not refund the value of the Gift to the Participant.

5. Complaints

5.1 Any complaints regarding the manner of conducting a given Promotional Campaign should be submitted by Participants in writing during the duration of a given Promotional Campaign, but no later than within 14 days from the date of completion of a given Promotional Campaign to the address of the Organizer's registered office: BEAUTY BRANDS ECOMMERCE Sp. z oo ul. Żytnia 19 05-506 Lesznowola. The deadline for filing a complaint is considered to have been met if the Participant posts the letter at a public operator's post office within that time. The Organizer is not obliged to consider the complaint if the complaint is sent to the Organizer after the deadline specified in this provision.

5.2 A written complaint should include the name, surname and detailed address of the Participant, as well as a detailed description and reason for the complaint along with the justification and the name of the Promotional Campaign of which he was a Participant.

5.3 Complaints will be considered immediately, but no later than within 14 days from the date of their receipt by the Organizer.

5.4 The Participant will be notified of the Organiser’s decision by registered mail sent to the address provided in the complaint within 7 days from the date of consideration of the complaint.

5.5 The Participant has the right to appeal against the Organizer’s decision to the Court.

5.6 Complaints regarding purchased Promotional Products in the Online Store during a given Promotional Campaign are considered in accordance with the general principles set out in generally applicable legal provisions, in particular in the Civil Code.

6. Personal data

6.1 The Organizer declares that personal data collected and processed by the Organizer as the controller of personal data will be used solely within the framework of and for the purposes of the Promotional Campaign, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the Regulation), i.e., among others, for the purposes of selling Promotional Products, shipping Promotional Products, and considering any complaints.

6.2 Pursuant to Article 13 paragraphs 1 and 2 of the General Data Protection Regulation of 27 April 2016, the Organizer informs that:
a) The administrator of the personal data of the participant of the Promotional Campaign is Beauty Brands Ecommerce sp. z o. o. with its registered office at ul. Żytnia 19, 05-506 Lesznowola, REGON: 381956358, NIP: 1231417982. Personal data may also be transferred to entities providing courier or postal services for the purpose of sending Promotional Products, payment operators and banks. Personal data will be processed by the Administrator, as well as entities to which the data will be entrusted solely for the purpose specified in these Regulations,
b) the personal data of Participants will be processed for the purpose of participating in a specific Promotional Campaign and may also be processed for the purpose of considering any complaints and for the purpose of defending or pursuing any claims, based on the "legitimate interest of the Administrator",
c) the personal data of Participants will be stored until the consent to the processing of personal data is withdrawn and until the limitation of any claims within the period provided for by law, counted from the end of a given Promotional Campaign or the withdrawal of the consent by the Participant to the processing of personal data, unless EU or national law requires the storage of personal data for a longer period,
d) The Participant has the right to request access to his/her personal data, its rectification, deletion, restriction of processing and its transfer,
e) The Participant has the right to object to the processing of his or her personal data based on a legitimate interest, to lodge a complaint with the supervisory authority and to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal,
f) The Participant who has consented to the processing of personal data may contact the Data Protection Inspector directly in all matters related to the processing of his/her personal data at iod@m3mcom.pl

7. Final provisions

7.1. These Promotional Campaign Regulations are effective from 20.03.2024 and apply to all Promotional Campaigns implemented under the terms specified in point I and point III section 4 of the Regulations. The Regulations are available until they are changed/cancelled on the website of the Online Store https://eveline.pl/regulamin-akcji-promocyjnych , subject to situations in which the Online Store fails, and at the registered office of the Organizer.

7.2 In justified cases, the Organizer reserves the right to change these Regulations, without prejudice to the rights acquired by the Participants before the date of making the changes.

7.3 In the event of any changes to the Regulations, the Organizer will inform the Participants by posting appropriate information on the Online Store website https://eveline.pl/regulamin-akcji-promocyjnych .

7.4 The amended version of the Regulations is effective from the moment of publication.

7.5 Both the Participants and the Organiser will strive to resolve any disputes arising from the Promotional Campaign Regulations in an amicable manner, through negotiation.

7.6 Any disputes arising from the performance of obligations related to this Promotional Campaign shall be resolved by the court having jurisdiction over the seat of the Defendant.

7.7 In matters not regulated by these Regulations, the provisions of the Civil Code shall apply.

7.8 The Regulations enter into force on 20/03/2024 at 12:00.
